1. Definitions
1.1 "Company" means Ricky Timber Flooring Pty Ltd, ABN: 81 658 439 064.
1.2 "Customer" means the business customer or consumer of the Company.
1.3 "Manufacturer" means the original manufacturers or wholesalers of the Goods and their distributors.
1.4 "Contract" means any agreement for the sale of Goods or services by the Company to the Customer.
1.5 "Goods" means all products supplied by the Company including parts, components, and flooring materials.
1.6 "Flooring Accessories" include, but are not limited to, scotia's, end profiles, 3-in-1 trims, stair nosing, and similar accessories.
2. Application
2.1 These Terms apply to all sales and services provided by Ricky Timber Flooring.
2.2 No amendments or waivers are valid unless agreed in writing by the Company.
3. Quotations
3.1 Quotes are valid for 30 days unless otherwise specified.
3.2 The Company reserves the right to withdraw any quotation prior to acceptance.
3.3 Verbal quotes are based on real-time availability but not guaranteed unless confirmed with an order.
3.4 All valid quotations must be in writing and approved by Company personnel.
4. Prices
4.1 Pricing is subject to change until a deposit is paid. All prices are in AUD.
5. Payments
5.1 Invoices must be paid in accordance with the terms specified.
5.2 A 40% deposit is required to confirm any order.
5.3 Payment of the deposit confirms acceptance of the quotation and these Terms.
5.4 Full payment must be made before pickup or delivery.
5.5 If payment terms apply, invoices must be paid in full without unauthorized deductions.
5.6 Acceptable payment methods: direct deposit, cash, bank cheque, or credit card (excluding Amex, Diners Club, and personal cheques).
5.7 Disputes must be raised in writing within 7 days. Undisputed amounts must be paid on time.
5.8 Overdue accounts may be sent to debt collection. The Customer is responsible for all recovery costs, including legal fees.
5.9 The remaining 60% balance is payable at least 48 hours before installation.
6. Product Description
6.1 Samples are representative only. Variations may occur.
6.2 Natural materials may show variations due to the manufacturing process.
7. Flooring Conditions
7.1 Orders for flooring materials (engineered timber, laminate, vinyl, hybrid) are governed solely by these Terms.
7.2 Timber is a natural product and may vary in color, texture, and shape. These variations are not grounds for warranty claims.
7.3 Warranty does not cover labor for replacement of defective materials once installation has commenced.
7.4 Customers are responsible for any incidental damage during installation.
7.5 Painting of skirting, scotia, or trims is not included in the Company’s scope of work.
7.6 Renamed flooring products are covered under the original Manufacturer’s warranties.
7.7 Engineered timber may include up to 33% "nestled" boards.
7.8 The Company and Manufacturer are not liable for issues caused by site conditions or improper installation.
7.9 Installers provided by the Company are contractors. While care is taken, the Company is not liable for their work.
8. Flooring Care & Maintenance
8.1 Customers must follow the Manufacturer's maintenance guidelines.
8.2 Incorrect care voids the warranty.
8.3 General cleaning includes:

Soft broom or vacuum

Damp microfiber mop with manufacturer-approved solution
-
Felt pads under furniture and soft casters on chairs
9. Supply-Only Orders
9.1 For supply-only orders, the Customer is responsible for correct measurements.
9.2 All products must be inspected before installation.
9.3 The Company is not responsible for installer errors or installation outcomes.
9.4 Site conditions are the Customer’s responsibility:

Subfloor flatness tolerance: 3mm over 3 meters

Clean, dry, level subfloor

Proper expansion gaps as per Manufacturer’s specs

Correct installation method for each flooring type
9.5 No liability is accepted for failures due to poor site conditions or incorrect installation.
9.6 Manufacturer's warranty does not cover floating floor gaps from structural movement.
9.7 Sunlight or moisture-related expansion/contraction is not covered.
10. Ownership & Risk
10.1 Risk passes to the Customer upon delivery or collection.
10.2 Ownership remains with the Company until full payment is received.
11. Warranty & Claims
11.1 Warranties are in addition to rights under Australian Consumer Law.
11.2 Any defects must be reported within 7 days of delivery.
11.3 Claims must include proof of purchase and product inspection.
12. Indirect Loss
12.1 The Company is not liable for indirect or consequential damages, including loss of income, business, or reputation.
13. Severability
13.1 If any term is invalid, the remaining Terms will continue in effect.
14. Structural & Subfloors
14.1 Subfloor preparation is the Customer’s responsibility unless otherwise agreed.
14.2 If the subfloor is unsuitable and the Customer declines remedial work, the Company may refuse to proceed.
15. On-Site Access
15.1 The Customer must provide safe access to the work site with power and water available.
16. Furniture & Personal Items
16.1 The Customer must remove furniture and valuables before installation.
16.2 The Company is not responsible for damage to items not removed.
16.3 If moving services are arranged, all care is taken but no responsibility for damage is accepted.
16.4 Cabinets and storage units must be emptied in advance.
16.5 The Company does not move heavy specialty furniture (e.g., pianos, billiard tables).
16.6 The Company does not reinstall plumbing or electrical appliances.
